Abstract: This paper summarized the current situation of the seed related illegal cases of “the connection of the two laws ” in Zhangye national hybrid corn seed base in recent years, and analysed the problems existing in the illegal cases. By considering the “ competitive application” of administrative punishment and criminal punishment in seed related criminal cases, the solutions of “ transfer after punishment ”, “ punishment after tvansfev ”and “punishment after exemption” was disscussed and put forward, which provided reference for comprehensive agricultural administrative law enforcement agencies at all levels to handle similar seed cases in the future.
