国家公园分区管控法律制度研究基于《中华人民共和国国家公园法》的规范解读

Research on the legal system of zoning control in national parks: based on the normative interpretation of National Park Law of the People’s Republic of China

  • 摘要: 国家公园分区管控制度是落实党的二十届三中全会提出的“全面推进以国家公园为主体的自然保护地体系建设”战略部署的关键制度,也是贯彻习近平生态文明思想的关键举措。国家公园分区管控制度以分区域、差异化、精准管控为核心,依据不同区域的特性实施针对性的管理措施,以平衡国家公园肩负的多重生态功能。随着《国家公园法》的颁布实施,国家公园体系建设进入了全新的法治化阶段,从根本上解决了国家公园分区管控制度长期缺乏上位法依据的困境,步入了规范化新阶段。法律的实施是一个循序渐进的过程,从“有法可依”到“良法善治”仍要经历完善与落地过程。构建体系完整、科学规范的分区管控制度,是国家公园体制建设的内在需求。以差异化管理理论为基础,应当从完善国家公园分区标准、设置国家公园分区动态调整机制、健全分区管控差异化法律责任等维度,积极探索国家公园分区管控制度的优化路径。

     

    Abstract: The national park zoning control system is the key institution for implementing the strategic deployment of "comprehensively promoting the construction of a natural protected area system with national parks as the main body" proposed by the Third Plenary Session of the 20th Central Committee of the Communist Party of China. It is also a crucial measure to implement Xi Jinping's Thought on Ecological Civilization into practice. Centered on regionalized, differentiated, and precise control, the national park zoning control system applied targeted management measures based on the specific characteristics of different regions to balance the multiple ecological functions borne by national parks. With the promulgation and implementation of the National Park Law, the construction of China's national park system has entered a new stage of legalization, which has fundamentally resolved the long-standing dilemma wherein the zoning control system lacked a higher-level legal basis, ushering it into a new phase of standardization. However, the implementation of the law is a gradual process; transitioning from "having laws to rely on" to "good laws and good governance" still requires an ongoing process of refinement and execution. Constructing a comprehensive, scientific, and standardized zoning control system is an inherent requirement for the institutional development of national parks. Based on the theory of differentiated management, we should actively explore optimization pathways for the national park zoning control system across several dimensions: improving national park zoning standards, establishing a dynamic adjustment mechanism for national park zoning, and perfecting the differentiated legal liabilities associated with zoning control.
